The DMCA

The Digital Millennium Copyright Act (“DMCA”) creates a standardized process for copyright holders (including software developers) to ask GPA Enterprises, LLC (“gpaenterprises.com”) to take down infringing content. You can find more information about the DMCA at the U.S. Copyright Office's official website. As with all legal matters, it is always best to consult with a professional about your specific questions or situation. We strongly encourage you to do so before taking any action that might impact your rights. Our guides are NOT legal advice and shouldn't be taken as such.

Accurate Information

Under the DMCA, you must confirm the accuracy of the details in your infringement notice under penalty of perjury. Knowingly providing false information in a sworn statement is a federal offense (see U.S. Code, Title 18, Section 1621). Additionally, submitting incorrect information may lead to civil liability, meaning you could be sued for financial damages.

Investigate

Creators and organizations put significant effort and passion into the content they produce on gpaenterprises.com. Submitting a DMCA infringement notice is a serious legal action that can have real consequences for those involved. Therefore, we strongly encourage you to carefully investigate the matter and seek legal advice to ensure the use isn't legally allowed before filing a takedown request. Before proceeding with a takedown notice, consider reaching out to the user directly as a first step.

No Automated Bots

A qualified professional should review the details of each takedown notice before submission. If you rely on a third party for this process, ensure you understand their methods and confirm they are not using automated bots to file bulk notices. Such notices are often invalid and can lead to the unnecessary removal of content.

Counter Notices

If a user impacted by your takedown notice chooses to file a counter-notice, we will restore their content within 14 days unless you inform us that you have taken legal action to prevent them from engaging in alleged infringement on gpaenterprises.com.

The Determination

Gpaenterprises.com has a limited role in this process, primarily ensuring that notices meet the basic requirements of the DMCA. It is the responsibility of the involved parties (and their legal representatives) to assess the validity of their claims, keeping in mind that submissions are made under penalty of perjury.
